Some charges dismissed in deer killing case

WAUPACA (WKOW)-- Some charges surrounding animal cruelty case involving snowmobilers running down deer are dropped.

A judge dismissed felony animal cruelty charges against the second of three men accused of running down deer with snowmobiles last January, killing four of the animals. A fifth deer had to be euthanized.

Waupaca County Circuit Judge Philip Kirk ordered the charges against 24-year-old Rory Kuenzi dismissed after prosecutors declined to dismiss them.

A similar decision was made earlier to drop animal cruelty charges against his 23-year-old brother Robby Kuenzi, whose lawyer successfully argued that state law prohibits those charges against someone who is hunting.

The judge noted that prosecutors filed several misdemeanor charges and ordinance violations in the case alleging such things as hunting without a license and hunting during a closed season.

Nicholas Hermes, 23, faces similar charges and is due in court July 22.
