HACKENSACK, NJ (WKOW) -- Edward Ates says he was too fat to have murdered his son-in-law in 2006.
Last month, a jury convicted the 65-year-old of shooting and killing Paul Duncsak in his New Jersey home. At the time of the crime, Ates weighed 285 pounds.
During his six-week trial, the defense rested on claims he was too fat to have run up and down stairs to shoot Duncsak, then escape by driving more than 20 hours to his mother's home in Louisiana.
Ate's attorney plans to appeal.
The victim and Ate's daughter were divorced and involved in a bitter custody dispute.
