MILWAUKEE (WKOW) -- The couple in a train versus van collision in suburban Milwaukee last Memorial Day are suing the railroad.
The attorney for Scott and Monica Partenfelder says Canadian Pacific Railway knew there would be more traffic at an Elm Grove Crossing because of a parade and that they should have been more cautious.
Scott and an Elm Grove police officer were severely hurt when they helped pull Monica and the couple's 2-year-old son from the van before the train hit it on the tracks.
Partenfelder is suing for more than $300,000 in medical expenses.
The railroad says it has no comment on the lawsuit.
