MADISON (WKOW) -- The owners of a popular campus-area bar have agreed to drop their lawsuit and accept the University of Wisconsin-Madison's $2.1 million offer for their property.
Fortney, Fortney and Fortney LLC, the owners of Brothers Bar & Grill on University Ave. agreed to dismiss the lawsuit that sought to stop the UW from taking their property through eminent domain, one day before the case was to go to trial in Dane County court.
The university will pay within the next 30 days.
The Fortneys and their attorneys could not immediately be reached for comment. A UW system spokesman said the system was waiting for a signed order from a judge before commenting.
In February, Eric Fortney told 27 News the UW wanted to force them out to build a multi-million dollar music school in its place.
David Giroux from the UW Board of Regents says the UW music school building project has been in the works since 2005. Giroux says Brothers Bar bought the property after 2005, knowing they would have to move when the project got underway.
