RIVERSIDE, CA (WKOW)--A federal judge Thursday declared the U.S. military's ban on openly homosexual service members unconstitutional.
Southern California U.S. District Judge Virginia Phillips approved an injunction to stop the government's "don't ask, don't tell" policy for gays and lesbians in the military.
Phillips says the policy doesn't help military readiness and instead has a "direct and deleterious effect" on the armed services.
Government lawyers argued this was an issue Congress, not Phillips, is authorized to decide.
The case was brought by the Log Cabin Republicans, a 19,000-member group that includes current and former military members.
