Defense says fatal shooting of Tomah man was accident
SPARTA, Wis. (WKOW) -- The defense attorney for the Illinois woman accused of killing her ex-boyfriend about a year ago says the shooting in Monroe County was an accident.
Prosecutors claim that Tammy Cole, 47, shot Vance Evans, 53, in the head last April because she was jealous of his new relationship. But defense attorney Kristine Peshek argued Monday in Monroe County Circuit Court that the gunshot's trajectory doesn't indicate an execution.
District Attorney Dan Cary told jurors that after Cole killed Evans in his Tomah home, she lit a candle while natural gas hissed from a broken stove pipe. Evans' new girlfriend, Mary Mclain, says she discovered his body on the living room floor and smelled gas when she entered the house, reports the La Crosse Tribune.
Testimony is expected to resume Tuesday.
