MADISON (WKOW) -- Esther and Edward York are putting the past behind them, including a cold, frozen day back in February.
"I was walking towards our vehicle and before I knew it, I fell flat on my chest," said Esther York.
"We just came out of Arby's and she told me to watch the ice cause I have an artificial leg and she was worried about me falling," said her husband Edward. "The next thing I knew she was laying on the ground."
"Two days after that I went to my family doctor and all my ribs were sprained," said Esther.
"The cartilage was all torn from her ribs," said Edward.
Arby's told the Yorks, it would pay up to $5,000 for Esther's medical bills but wouldn't cover her lost wages.
"It ended up being six weeks that I couldn't work," said Esther.
Arby's said the icy parking lot conditions wasn't it's fault. That's because they had called Wisconsin Snow and Ice Removal Company three times that day to have its lot cleared. But no one showed up. Esther was told the snow removal company was responsible for her lost wages.
"My husband called five or six times and left messages and nobody ever called us back," said Esther.
That's when Call for Action got involved. After several calls to both businesses, Arby's owner decided to step up.
"A couple days later, Arby's insurance called and offered to pay 80 percent of my wife's wages, even though he said we are not responsible for it," said Edward.
Either way, the York's were grateful to get that check in April. Also, for the help that put the fall behind them.
"I appreciate that very much and I appreciate Arby's stepping up and paying what they said they wouldn't at first," said Esther.
