MADISON (WKOW) -- Family members say 9-year-old Bailee Chadwick, who was hit by a car on Vera Court Sunday night, continues to heal.

"They are helping her just to get moving again. She's definitely doing a lot better," Bailee's aunt Michelle Melchor tells 27 News.

Melchor says the family hopes Bailee will be out of the ICU  in a few days after suffering internal injuries. She's being treated at the American Family Children's Hospital in Madison. "She's going to need lots of physical therapy and therapy from a psychiatrist as well because she's so traumatized by what happened. She remembers everything."

Melchor says she remembers everything too. She was there the night Bailee was run over. "Our whole family's traumatized by what happened, it should have never happened," she says.

Police arrested 34-year-old Miracle Loyd following the accident for being intoxicated behind the wheel. Loyd didn't appear in court this week and Thursday, she was released from jail.

"She's out, and my family and I are very upset about that," Melchor says.

Dane County District Attorney Ismael Ozanne says his office still needs to review evidence, including a toxicology report. He says they hope to make a decision about charges as soon as possible. There are often time limits on holding suspects without formal charges.

Melchor is concerned about Loyd's long criminal history. Court documents show three years ago, she ran her car into an acquaintance, after a dispute.

"You just can't release that type of person from jail. Especially if they have a criminal history and its happened in the past," Melchor says.

Ozanne says he doesn't consider Loyd a flight risk because she remained on the scene after the accident Sunday.

Melchor says the family hopes justice is served, but they're focusing on keeping Bailee positive as she gets better.

MADISON (WKOW) --- The woman arrested for hitting a girl while driving under the influence, is out of jail.

The Dane County jail says 34-year-old Miracle Loyd has been released.

She was released on Thursday.

Dane County District Attorney, Ismael Ozanne, tell us toxicology results are not yet back and they are still gathering evidence.

They plan to make a decision on charges as soon as they can, but they do not believe Loyd is a flight risk.

Loyd was arrested after the accident on Sunday night.
