WI appeals court orders new trial for Beloit man

MADISON (WKOW) -- A new trial has been ordered for a Beloit man convicted of fatally stabbing his ex-girlfriend.

Donyil Anderson was sentenced to life in prison in the 2008 slaying of Stacey Hosey. He also received a 20-year sentence for the attempted slaying of her boyfriend Brandon Beavers-Jackson.

On Thursday, a Wisconsin appeals court sent Anderson's case back for a new trial.

Anderson's appeal argued that his mental state was influenced because he took Strattera, a drug used to treat attention deficit hyperactivity disorder. His appeal also argued the instructions to the jury didn't distinguish between voluntarily taking a lawfully prescribed medication and the use of illegal drugs.

Anderson's attorney William Schmaal said he had not time to fully understand the decision and could not yet comment.
