Kristen Smith to appear in federal court Friday

MADISON (WKOW) -- The U.S. Attorney's Office in Madison has indicted Kristen Smith, the woman charged with kidnapping Kayden Powell from a Beloit home. 

A spokeswoman for the U.S. Attorney's Office says Smith will be transferred from Iowa sometime before Friday.  She is scheduled for an extradition hearing in Iowa Thursday morning.  Her initial appearance in federal court, here, will be Friday afternoon.

Smith was arrested in Iowa after investigators say Smith took her half-sister's baby February 6 and left him behind a West Branch, Iowa gas station in freezing temperatures.  He was found alive 29 hours later.  She has been held there since then and had a warrant out on her in Texas.  Smith has pleaded guilty to her charges in Texas and her extradition there has been waived. 

If convicted, Smith faces a maximum penalty of life in federal prison.  Those involved in the investigation were the Town of Beloit Police Department; City of Beloit Police Department; Federal Bureau of Investigation; Rock County Sheriff’s Department; Wisconsin Department of Justice, Division of Criminal Investigation; West Branch (Iowa) Police Department; Cedar County (Iowa) Sheriff’s Office; Iowa State Patrol; Iowa Division of Criminal Investigation; Illinois State Police; Wisconsin Statewide Information Center; and Illinois State Terrorism and Intelligence Center.
