Accused kidnapper Kristen Smith faces amended charge

Posted: Updated:

MADISON (WKOW) -- The woman accused of kidnapping an infant from the Town of Beloit now faces an amended federal charge.

A federal grand jury returned the indictment Wednesday against 31-year-old Kristen Smith. Smith is charged in a superseding indictment with kidnapping an individual who had not attained the age of 18 years, and transporting the victim in interstate commerce from Wisconsin to Iowa.

Smith was originally indicted on February 19, but this superseding indictment triggers a mandatory minimum penalty of 25 years in prison, if Smith is convicted. The maximum penalty is life in prison.

Smith is accused of kidnapping baby Kayden Powell from a home in the town of Beloit on February 6. Powell was just a few days old at the time. Authorities say she abandoned the child outside a gas station in West Branch, Iowa. The boy was found alive.

Smith is the boy's aunt.
