Update: Attorney says older brother tried to stop interstate shooting

MADISON (WKOW) --  An attorney for one of the brothers captured after a deadly interstate shooting says the man tried to stop his younger brother from opening fire, taking at least one gun away from him.

30-year old Jeremy Hays of West Allis appeared in Dane County court Friday for the purposes of bail.  A court commissioner set Hays' bail at $10,000.

Authorities say Hays' 20-year old brother, Zachary Hays, is the suspect in the killing of a 42-year old man in West Allis Sunday.  Zachary Hays is charged with the later, drive-by shooting of a 44-year old Tracy Czaczkowski, an Illinois traveler who was on I-90-94 with her family.

Authorities say Jeremy Hays told detectives Zachary Hays became paranoid after smoking marijuana a few days before the Sunday violence.

The third brother, Jeffrey Hays, was arrested on a charge of expelling bodily fluids at a law enforcement officer, and has been in the Dane County jail for six days without making a court appearance.  Authorities say Jeffrey Hays has a cognitive disability.

After the deadly interstate shooting, authorities say Zachary Hayes was shot and wounded by deputies, when Hays refused to obey police orders and approached them with a gun.  Zachary Hays is at UW Hospital.


MADISON (WKOW) -- Two of three brothers arrested after a deadly shooting on I-90/94 Sunday are scheduled to appear in Dane County court Friday.

30-year old Jeremy Hays is jailed on the tentative charge of a felon in possession of a firearm. 

34-year old Jeffrey Hays is jailed on the tentative charge of expelling bodily fluid at a law enforcement officer.  Authorities say Jeffrey Hays is cognitively disabled.

Authorities say a third brother, 20-year old Zachary Hays, is charged in the fatal, drive-by shooting of a 44-year old Illinois woman on the interstate.  Hays is also a suspect in an earlier homicide Sunday of a 42-year old man in West Allis.

Authorities say Zachary Hays was shot and wounded by Sheriff's deputies a short time after the woman's killing, when he ignored police orders.  Hays remains at UW-Hospital.
