Madison man charged in jogger attack

MADISON (WKOW) -- A Madison man was charged with felony battery Tuesday as authorities say he randomly punched a passing jogger on the city's east side.

A criminal complaint states the 26-year old victim was on Winnebago Street near a convenience store around 9 p.m. Aug. 23 as part of his regular, running route when Tyler C. Smith reached out and punched him in the face.  Court records say the blow broke the victim's nose and injured his eye.

According to the complaint, Smith told a detective the jogger ran into him, and the punch was inadvertent.

Mark Kroon owns Players Sports Bar and Grill across the street from the scene of the violence.  He says his business' exterior, surveillance cameras captured Smith acting aggressively minutes before the attack, and also appearing on camera just ahead of the victim just after the incident.  The complaint states the victim initially chased the defendant.

Kroon says detectives believed the surveillance video was important to building a case against Smith.  Police spokesperson Joel DeSpain says surveillance video from several locations near the attack was examined, with images from the inside of a nearby location the key to confirming Smith's identity.
 

"The Madison Police Department was all over it,"  Kroon says.
 

A court commissioner ordered Smith to have no contact with the victim, and released Smith on a signature bond.  He's due in court again next month.
