MADISON (WKOW) -- The estate of murdered UW student Brittany Zimmermann filed a lawsuit Tuesday against Dane County.
The civil suit is for wrongful death: Zimmermann's family says negligence on the part of Dane County, County Executive Kathleen Falk and former 911 dispatcher Rita Gahagan led to their daughter's murder.
The Wisconsin State Journal reports the suit claims Falk and Dane County quote "negligently or intentionally" caused emotional distress to the Zimmermanns by initially denying they knew of a 911 call from their daughter's phone that was made before she died, when they actually knew of it within seven hours of her death on April 2.
The county did finally admit there was a call but claimed no sounds of an emergency were heard.
According to a search warrant unsealed last month in Dane County Circuit Court, screaming and the sounds of a struggle could be heard on the recording.
There's no mention of monetary demands in this suit.
